StackedPlateDining Legal
Terms and Conditions
These Terms and Conditions set out how you may access and use the StackedPlateDining website, reserve our premium dining experiences, and participate in our exclusive offline poker events and private functions in Australia.
1. Overview
Introduction
These Terms and Conditions govern your use of the StackedPlateDining website located at https://stackedplatedining.com and any related online services we provide in connection with our premium Australian restaurant. This includes, without limitation, access to information about our luxury dining experiences, reservations for our restaurant, bookings for poker events and tournaments, VIP lounge access, and private function enquiries.
By using this website, you acknowledge that StackedPlateDining is a hospitality and social entertainment venue combining elevated coastal dining with exclusive offline poker experiences, private poker evenings, live tournaments, and VIP lounge services. These Terms and Conditions are designed to ensure that your experience remains safe, respectful, and aligned with responsible hospitality and gaming practices in Australia.
Additional terms, venue signage, and written agreements may apply to specific services such as private functions, corporate bookings, or VIP membership. To the extent of any inconsistency, those specific terms will prevail in relation to the relevant service.
2. Agreement to our policies
Acceptance of Terms
By accessing or using our website, making a reservation, submitting an event or function enquiry, purchasing or redeeming any service, or attending our venue for dining, poker events, or VIP lounge access, you agree to be bound by these Terms and Conditions as updated from time to time.
Your use of the website and services also indicates your agreement to our Privacy Policy and Cookie Policy, which explain how we collect, use, and protect your personal information and your choices in relation to cookies and similar technologies.
If you do not agree with these Terms and Conditions or any other applicable policy, you must not use this website, make a booking, or attend any StackedPlateDining event under those terms. Where you make a reservation or booking on behalf of another person or group, you represent that you are authorised to do so and that all guests you represent have been made aware of, and agree to, these Terms and Conditions.
3. Responsible access
Eligibility and Age Restrictions
StackedPlateDining operates as a premium hospitality venue in Australia. Access to certain areas and services is subject to eligibility and age-based restrictions to support responsible gaming and compliance with local legislation.
- Dining areas: Our primary restaurant and terrace dining areas are generally open to guests of all ages, subject to any licensing conditions and booking rules that may apply from time to time.
- Poker events and tables: Access to all poker events, regular offline poker nights, live tournaments, and poker tables is strictly limited to guests aged 18 years or above.
- VIP lounges and private poker rooms: Entry to our VIP lounges, private poker rooms, and other restricted gaming-adjacent areas is also limited to guests aged 18 years or above.
We may request valid, government-issued photo identification (such as an Australian driver licence, passport, or proof-of-age card) to verify age at the point of entry, at the table, or when processing reservations. If suitable identification cannot be produced on request, we may refuse entry or limit access to restricted services at our sole discretion.
By attending poker events or entering VIP areas, you warrant that you are at least 18 years of age and legally permitted to participate in such activities in Australia.
4. Bookings and reservations
Reservation Policy
All reservations and booking requests made via our website, through the Reservations page, via the Contact Us page, or through our team directly, are subject to availability and to any specific booking conditions notified at the time of booking.
The following general principles apply unless otherwise specified in your confirmation:
- Confirmation: A reservation is regarded as confirmed only once you receive written confirmation from us (for example by email or SMS). We reserve the right to decline a booking request at our discretion.
- Arrival times: You are responsible for arriving on time for your booking. Late arrivals may reduce your allocated dining or event duration and, during peak periods, may result in your table or place in an event being released.
- Cancellations and changes: Cancellations or changes must be made within the timeframes specified in your booking confirmation or otherwise notified to you by our team. Changes received outside these timeframes may be treated as a late cancellation or no-show.
- Fees and charges: We may apply cancellation fees, pre-paid minimum spends, or holding deposits for certain dining reservations, special events, or peak times. Any such fees or deposit conditions will be communicated clearly at the time of booking.
- No-shows: If you fail to attend at the confirmed time and do not provide the required notice, we may treat your reservation as a no-show and may retain any applicable deposit or charge a no-show fee in line with the conditions notified at the time of booking.
We reserve the right to adjust seating allocations, table configurations, and event layouts to maintain the comfort, safety, and overall experience of all guests at StackedPlateDining.
5. Poker evenings and tournaments
Poker Event Rules
Participation in any StackedPlateDining offline poker evening, private table, or live tournament listed on our Events page or promoted onsite is governed by venue-specific rules, responsible gaming principles, and these Terms and Conditions.
Without limiting our detailed rules advised at the venue or during registration, you agree that:
- Registration: You must register accurately for poker events, providing true and complete information. We may refuse, cancel, or limit a registration where we reasonably believe it to be fraudulent, misleading, or otherwise inappropriate.
- Venue etiquette: You must follow all table rules, dealer directions, and reasonable instructions from our staff at all times. Respectful behaviour towards other guests and team members is mandatory.
- Responsible gaming: You agree to engage in poker activities responsibly. We may, at our discretion, limit or refuse further participation in events if we have concerns regarding your wellbeing, conduct, or compliance with responsible gaming standards.
- Misconduct: Cheating, collusion, intimidation, harassment, disruptive behaviour, or any form of unlawful or unsafe conduct will not be tolerated and may result in immediate removal from the table or venue, forfeiture of buy-ins or prizes where permitted by law, and potential exclusion from future events.
- Rules variations: The structure, format, buy-in, prize pool, blinds, and house rules for each poker event may vary and will be communicated in advance or at registration. Event details may be adjusted where necessary for operational or safety reasons.
Our decisions concerning the application of event rules, etiquette, and responsible gaming practices are final to the fullest extent permitted by law.
6. Event and group bookings
Private Functions & Corporate Bookings
StackedPlateDining offers bespoke private functions, corporate entertainment, team-building events, and custom poker-themed evenings that can be initiated via our Functions or Contact Us pages.
All such functions and corporate bookings are subject to formal written agreements, which may include proposals, contracts, function sheets, or email confirmations outlining specific inclusions and conditions. You acknowledge that:
- Custom packages: Each private function may include tailored menu selections, beverage options, poker tables, room hire, styling, and entertainment add-ons. These inclusions and any limitations will be specified in writing.
- Deposits: A deposit or partial pre-payment may be required to secure your date and package. Deposit amounts, due dates, and payment methods will be stated in your written agreement.
- Minimum spends: Minimum spend thresholds may apply to private rooms, VIP lounges, or exclusive areas. If the agreed minimum spend is not met, we may charge the shortfall as specified in your function agreement.
- Cancellations and amendments: Cancellation deadlines, amendment rules, and any applicable fees or forfeiture of deposits will be detailed in your written confirmation. By proceeding with your booking, you agree to those terms.
- Final numbers: You must confirm final guest numbers within the timeframe specified by us. Charges will generally be based on the confirmed final numbers or the actual attendance, whichever is greater, subject to the terms of your agreement.
Where any conflict arises between these Terms and Conditions and a signed function or corporate agreement, the signed agreement will prevail for that specific event to the extent of the inconsistency.
7. VIP experiences
VIP Membership Terms
StackedPlateDining may offer a VIP Lounge program, membership tiers, or loyalty benefits, as described from time to time on our Lounge page or in direct communications to members. These programs are designed to provide exclusive access to premium seating, concierge services, private poker rooms, and curated hospitality experiences.
Unless otherwise specified in a separate membership agreement, the following terms apply:
- Eligibility and approval: VIP membership and lounge access are offered at our discretion and may require an application, referral, or minimum spend. We reserve the right to approve, decline, suspend, or cancel membership without obligation to provide reasons, subject to applicable law.
- Good standing: Continued access to VIP benefits requires that you remain in good standing, which includes complying with these Terms and Conditions, meeting any applicable spend or visit requirements, and maintaining respectful conduct towards guests and staff.
- Use of benefits: VIP entitlements, such as priority reservations, exclusive event invitations, and loyalty rewards, are personal to the member and may not be sold, transferred, or assigned unless expressly permitted by us.
- Misuse and termination: Any misuse of membership privileges, including abuse of staff, disruptive conduct, fraudulent activity, or breach of house rules, may result in immediate suspension or termination of your membership and forfeiture of accrued benefits, to the extent permitted by law.
Specific VIP membership terms, including any fees, reward structures, and expiry dates, will be communicated to you upon enrolment or as updated from time to time.
8. Guest expectations
Venue Conduct and Dress Code
StackedPlateDining is designed as a relaxed yet refined coastal hospitality environment. To maintain a safe, comfortable, and premium atmosphere for all guests, you agree to observe our conduct standards and dress code whenever you visit the venue.
Without limitation, you agree that:
- Respectful behaviour: You will treat all other guests, staff, and contractors with courtesy and respect, refraining from harassment, discrimination, threatening behaviour, or any form of abuse.
- Dress code: Our standard dress code is smart casual or evening attire, as appropriate to the time and area of the venue. We may refuse entry where attire is considered unsafe, excessively casual, or inconsistent with the StackedPlateDining ambiance.
- Alcohol and safety: We operate in accordance with responsible service of alcohol obligations. We may decline service or access to guests who appear intoxicated or whose behaviour raises safety concerns.
- Prohibited items and activities: You must not bring unlawful substances, weapons, or dangerous items into the venue, nor may you engage in any illegal, unsafe, or disruptive activities on the premises.
We reserve the right to refuse entry, limit access to specific areas, or remove any guest from the premises where, in our reasonable opinion, their conduct, dress, or state of intoxication may adversely impact safety, comfort, or the enjoyment of others.
